17 RECEIVER
(ликвидатор) Лицо, осуществляющее в какой-либо форме управление конкурсной массой (receivership). При банкротстве (bankruptcy) официальный ликвидатор (official receiver) становится ликвидатором и распорядителем имущества банкрота. В тех случаях, когда залог ликвидных активов компании (floating charge), предоставленных в обеспечение ссуд, распространяется на все имущество компании и имела место кристаллизация, для управления всей деятельностью компании может быть назначен администратор -ликвидатор (administrative receiver). По Закону о неплатежеспособности администратор-ликвидатор обладает широкими полномочиями по ведению дел компании, распоряжению ее имуществом, началу процесса ликвидации (liquidation) и т.д. Если ликвидатор назначается в связи с фиксированным (конкретно определенным) имущественным залогом (ftxed charge), он может распоряжаться только тем имуществом, которое является залогом, и не имеет права управлять всеми делами компании. -
